I congratulate you for your activities done for India against corruption. I extend my full support to it and will be ready to do the work assigned to me by your good self. This is to invite your kind attention and seek your help or direction regarding one of the major problems of Judiciary area. Now a days the judiciary problem has become horrible particularly in high court, UP. One has to wait for not only years together but for decades together for his case to be heard despite of putting very hard & sincere efforts. Situation is so worst that the case is appearing in the hearing case list regularly every alternate week but never heard and it goes on for years together….. decades together. We keep requesting the Judges (mentioning) for the case to be heard but the request is always turned down, their answer is always to wait for your turn, the turn never comes. Following are the some reasons which gives rise to this problem (too much delay). 1. Hearing of listed cases given the last priority. 2. Court working timings mostly gets exhausted listening the fresh cases/admission cases/…etc. 3. If, at all, the hearing cases list is taken up which is rare chance, then 2-3 cases can be heard in the remaining time. 4. If a court is assigned exclusively for hearing of listed cases then the fresh cases of other courts whose Judges are on leave, are diverted to this court which is a regular phenomena, therefore the cases never heard. 5. Incomplete judgements by hon’ble judges. 6. Incompetancy of the Judges in the courts except Supreme Court. 7. Political influence. 8. Also sometimes Judges are assigned the other court or advocates strikes & various other reasons etc. These are a few reasons apart from that there are very less nos of Judges in the high court. There are 65 Judges in HC, UP against 160 nos (sanctioned) which are not sufficient to handle the quantum of the cases in HC. This crisis has been persisting last from more than 20 years but no solution to it yet. Govt. also knows this problem since long but does not want to do anything for the reasons of their political vested interests. It appears that there is a lack of govt. will. I am a great victim of this judiciary problem. I am fighting a case of my service last from 22 years. I was ilegally terminated by a PSU(IOCL) from the job in 1989 with out any reason after having worked for almost 3 years against permant post. I challenged the said termination in high court Allahabad and filed a writ petition(no-8502/89). After rigorous follow up, I was able to get the final judgment in my favor from HC in Dec’2006, after 18 years. The same order was stayed by division court(HC) in appeal (nos-19/2007 & 508/2007), UP. My present council is pursuing it up very hard for its disposal but failed due to the problem as listed above. No possibility of hearing the case in near future. It might take 3-4 years or more. I have taken the services of 8 councils during the pendency of the WP/ appeal just for the early disposel of the case. This kind of problem very persistant with govt. organisations/PSUs, where there is no answerability of a person because there is no loss to the any officer concerned who deliberately exercise such illegal acts. Had it been the pvt. organisation, they would have made all out efforts for coming out of such litigation at the earliest either amicably or by putting the all out efforts but this is not same with govt. organisations or PSUs. They are just interested in lingering the issue for long & long period so that the victim reaches to a point of self break down and then surrenders. I have seen many cases following the same trend. In that case, victim gets nothing except the job (lowest category. More over the hon’ble courts also does not come heavily on the organisations/Institutions/govt.body and make them bound to proceed as per law. In such circumstances, the most worrying part is that while awarding the judgment, Court does not award the full back wages even in genuine case. I have gone through many rulings of Supreme Court where Court has not awarded more than 50% back wages that too in very genuine cases(if not gainfully employed during the period in question) on the basis of no work & no pay rule. This is not a complete justice. When a person is not found guilty and has been pursuing the case very hard throughout and not gainfully employed then his rights should not be curtailed by the Court. When a person who is not earning and perusing the case very hard, one can imagine what could be his mental & financial state. How much money is incurred in fighting the court cases? He is never in a position to lead a good life and he also suffers on many fronts such as children’s studies, treatment for any ailment, social status, house, marriages of children etc. Court procedural delays should not be attributed to victim. In such circumstances prevaljng at the moment, many times, I think to commit suicide. Though, I do not run away from struggles but when the struggle continues so long and one has to listen bad words from all sides including all family members then person thinks to end his life. Just by awarding partial amount of backwages , would it not encourage the govt. system to continue to work in the same fashion as they have been suceeded to hit victim’s life including his family. Surely, this can not be viewed as Ideal Justice. Another fact is that whole family of victim abuses me(utters harsh words) just because of this un-ending litigation which has caused due to illegal termination. My family members see the other persons of IOC (of my cadre), leading a very good life. I am a victim of not only illegal termination but also a very poor judiciary system which has not succeeded to give proper justice in right time. It is very humiliating whenever I meet my relatives in functions etc. They also utters unpleasant words and hold me responsible for this trauma (bad time). Infact my all relatives wanted me to surrender to IOC management from the beginning and advised me not to fight litigation & never go against the management/officer’s will even for wrong doings. I strongly feel when I have not commited any crime/fault, why I should surrender? Though, I am right on my stand but I am always viewed by every one as culprit with hatered eyes just for the reason of illegal act excersized by IOC. This is the case which is concerned to me but, infact, this is universal problem for many thousands of people who are badly affected by this problem (judiciary). Many innocent people are in jail & not getting the bail just because of the reasons listed above. Since you are doing lot of work concerned to social welfare, my earnest request is that this problem should be highlighted at such a platform in a big way, also covered by the media so that this is also included in ongoing major issues such as corruption, black money & many other issues etc.. Can this problem be taken up in the supreme court through PIL?

Dear Anna Hazareji, Sri.Shanti Bhushan, Kiran Bedi, Arvind Kejriwal, I heartily congratulate you for laying the foundation for corruption free India. You are well aware that corruption is rampant in all walks of life. No paper will move in any Govt Dept without the officer accepting the bribe. Now that you have made a perfect take off and laid the foundation kindly give a thought to my under noted suggestion and I request you to kindly get feed back from all over India and the feed back can be crystallised to consolidate the things. If any body has given an application to any Govt Dept it will not pass without paying bribe or greasing the palms. Now any body who does not want to give will never be able to get his work done. No officer is accountable to pass the papers on time bound manner and they can delay it indefinitely and this is how they harass and collect bribes. My suggesting is to form ANNA'S BRIGADE (AB) ANNA'S VOLUNTEERS (AV)from All schools and collages accross India. After an application does not pass after say 5 or 6 visits and reminders it should be conveyed to AB or AV. They AB OR AV should again write giving an ultimatum that this application if not passed within 15 days or one month AB or AV will gherow them and complain to higher authorities including RTI office. Pl get feed back and if you think this is a good idea please move forward. Letter heads with Annaji's photograph. Badges and Photographs showing that it is ANNA'S BRIGADE OR AV should create some fear in the officers concerned. They should know that they will be exposed. To give you 2 instances which I know. 1.The multistories building is completed as per plan. Just to give corporation number Rs.35 lahks is demanded. In another case it is Rs.20/ lakhs. 2.Just to transfer the name in document in spite of the fact all documents are correct they are asking Rs.30,000/ 3.You name any work and there is rampant corruption. When the party is right and correct the AB or AV will do the trick. MPs and MLAs cannot do anything as they are busy with politicking. Only AB or AV can do it. Please give your E mail ids. I was totally disappointed today that there is already a rift between Kiran Bedi and Kejriwal. I wish and request you to respect each other and let not politicians divide and rule. I hope ego will take back seat and better counsel will prevail so that cancer of corruption can be eradicated to some extent.

Respected Anna Saheb: I shall be grateful if you can advise on the following matter. I saw the 8 pm telecast on AASTHA channel yesterday. ( September 01,2001. The speaker gave a spell binding presentation of the failure of our education system echoing what Baba Ramdev ji Maharaj aand you have been saying.I could not catch the name as my eyesight is very poor after suffering a heart attack and a stroke but I suspect that the speaker was Dr. Shib K. Mitra, Ex-Director, NCERT. I would like to contact the speaker and offer my full time involvement for revitalising the teaching -learning system.. Vande Matram Yours sincerely Krishna Vishnu Sane

R/ Anna ji, first of all, I want to congratulate you and your team for taking up the issue of corruption & creating an awareness in public. the whole nation is proud of you. I want to bring in your notice a very acute problem of judiciary. I am a great sufferer of that last from 22 years. you will see from the attachment where I have illustrated the problem of judiciary. Victim does not get the justice for decades to-gather. the whole problem lies with government. govt does not want to increase the judges in the court particularly in high courts. In UP the situation is worst. Govt. does not want to increase the judges for the sake of their vested interest. They think that they will be more under the attacks by the court judges by increasing the judges. They are least concerned with the problem of people. Not only I but many others are the victim of this problem. Many people are spending their lives in jail because their petition / appeal is not heard. There are only almost one third of the sanctioned strength of the judges for the last more than 20 years. there is no scope of hearing cases to be disposed off. I believe that if justice is not made in time, then this leads to increasing trend of irregularities to the very extent.

I am fully with Anna's movement for anti corruption. I also request the media to expose those dissidents including politicians and so-called social activists and journalists and column writers, who, are under the umbrage of government charity, having push flats, cars and all comforts and who support government when they need most to confuse people like what NAC people under Ms Sonia Gandhi and few column writers are doing to misguide the people. Many article writers are being shown in the TV and their dissenting opinions are being published in media but who are they? They are the people under government patronage. Let them declare their assets before the public domain and let media show these to the people. Not a single one in today's India has dedicated everything like Anna and Arvind Kezriwal. Before dissenting with Anna, let them mobilize people and be like Anna and sacrifice like Anna. The people of India today understands everything. They woke up. Let the media play the vital role of exposing these people and do not give any space in media to confuse the people and do not allow them to patronize government, the most corrupted and remote control driven government. This government has no right to stay in government even for a single minute. Let fresh franchise take place and let the people vote for those who will pass Janalokpal. Enough and enough discussions had taken place to confuse the people. But let the politicians know they are being sent to Parliament to serve the people's wishes and not to fulfill their corrupt wishes. People comes first, parliament follows. Today, as per various studies it is proved that across the country, except this most corrupted government and government-sponsored writers and social workers, entire country supports Anna. This government is so insensitive that today it is the 7th day of the fast of the man, who sacrificed entire life for the people. Let all the Indians across the Country and world stand behind Anna as this is the opportunity for every Indian to serve our motherland. Why the educated young do not come to politics but without any intention thronged behind Anna? Because if they join to politics they will only carry the flags of the leaders, who are the sons and nephews of the ministers and leaders, only who become the MPs and MLAs in this country like Indira, Rajiv and Rahul Gandhi. So why they will come? But they proved that how they love the country without any interest. They proved all allegations against them are wrong. We support Anna and we will be. Anna is not only writing history or re-writing history but creating history. Gandhi has given freedom from British to Indians and Anna will give the real freedom to Indians by eradicating corruption to a great extent through Janalokpal. I am sure that not a single sitting MP of this Govt will be re-elected and let the Indians take the oath on that. This corrupted Govt always attacked with its arrogance and might to those who tried to voice against corruption even they had not spared a mahatma like Anna. They need to be thrown away from the space of public life along with the govt sponsored and benefactors writers, columnists and social workers, who exist only on paper. These people do not have any support base and enjoy the comfort at the patronage of Govt for saying against Anna and to confuse the people of India. And let the MPs & MLAs clarify not to do what they want but to do what the people want otherwise not to vote to those political careerists.
